MINUTES of the Planning Committee Meeting held on 1 September 2020 Chair Approved

Public Questions: None.

Present; Cllr A Aldis (Chair), Cllr P Booth, Cllr Read, Cllr Tile, Cllr Boughton, Cllr Luxford-Vaughan and Jo Beighton-Emms (Town Clerk)
P09.20.001 Apologies for absence, None

P09.20.002 Declarations of interest: Cllr Aldis confirmed that any necessary declarations of interest will be raised when the Committee are considering matters throughout the course of the meeting.

P09.20.003 Minutes of the last meeting: The minutes of the meeting held on Tuesday 3 March 2020 were proposed by Cllr Booth, seconded by Cllr Tile and approved as an accurate record of proceedings.

P09.20.004 Planning Applications; The Committee considered the following planning applications. The Chair agreed for the committee to consider
planning applications referenced 201777 and 201813 which were not on the published agenda;

Development Extension of existing garage and part use of garage as ancillary accommodation.
Address 94 Broome Grove, Wivenhoe CO7 9QT
Comments/Resolution Comment; WTC has concerns regarding displacement of parking as the development offers no facility to park two vehicles off road. Also, that the development affects the view from number 96 Broome Grove and will block light. WTC asks that the planning officer takes these matters into consideration.

Comments/Resolution Comment; WTC has concerns regarding displacement of parking as the development offers no facility to park two vehicles off road. WTC ask that the planning officer is satisfied that two vehicles can be parked off road.

P09.20.005 Local Plan: Update from the Chair and Proposal to engage a Planning Consultant; Cllr Aldis explained the consultation process for
the Local Plan modifications which will run from 27 August for 6 weeks. Cllr Luxford-Vaughan reported that she had requested the Habitats Regulations Update and the updated version of the Section 1 text covered by the Main Modifications, which have now been circulated to all. Cllr Aldis and Cllr Luxford-Vaughan reported that they had both provided statements to the local press giving their comments on the Local Plan. They made the distinction that they were not commenting on behalf of the whole council but as councillors with knowledge of the Local Plan as agreed. Cllr Booth asked to see the statements.

Cllr Luxford-Vaughan reported that WTC had not been recognised as a consultee on the Environmental Consultation on the new link road, this had only come about because Elmstead Parish Council had brought this to our attention. WTC have until 3 September to comment- Cllr Evans is working on this response. Cllr Luxford-Vaughan agreed to circulate the report to all.

Regarding the proposal, Cllr Aldis explained that WTC only have 4 weeks in which to respond on the modifications and that this will be the council’s last chance to do so. There will not be a Hearing for the modifications. The planning consultant is highly effective and known to the inspector. Also, the consultant will be cheaper that engaging a barrister.

Cllr Luxford-Vaughan proposed that WTC spend £1250 on engaging the planning consultant, this was seconded by Cllr Boughton with all in favour.

Cllr Aldis repeated the suggestion made at July’s FTC that a letter be sent to CBC councillors Liddy, Cory, Luxford-Vaughan and ECC Cllr Young regarding their involvement in the Local Plan. Cllr Aldis suggested a vote of no confidence in those who he considered did not act on behalf of Wivenhoe. He will consider how best to respond on behalf of the town.

P09.20.006 Wivenhoe Neighbourhood Plan: Cllr Aldis said that the Wivenhoe Neighbourhood Plan must stay on the agenda to ensure that WTC
review it and consider actions in it.
Cllr Luxford-Vaughan confirmed that the review will be in June 2024 i.e 5 years from the date of ratification. Cllr Booth and Cllr Read said that WTC should plan for the land that will be gifted to WTC once development takes place. This will mean planning for the new cemetery and allotments. Cllr Read suggested that this should be a matter for FTC consideration. Cllr Luxford Vaughan suggested that the formation of a working group was included on the September FTC agenda and this was agreed by all.

P09.20.007 Leisure and Community Services SPD: No report was received for this month. The Town Clerk confirmed that she had contacted
CBC requesting that Wivenhoe’s allocation of S106 funds were set aside for the skatepark project but had not received a response. Town Clerk to chase so that there was no risk of the funds being reallocated elsewhere.

P09.20.008 Date and time of the next meeting: The date of the next Planning Committee meeting was agreed as Tuesday 6 October 2020 at 7.30pm
