MINUTES of the Planning Committee Meeting held on 3 March 2020 (Chair Approved)

P03.20.001 Apologies for absence Cllr Boughton, Cllr Evans and Cllr Luxford-Vaughan

P03.20.002 Declarations of interest: Cllr Aldis confirmed that any necessary declarations of interest will be raised when the Committee are considering matters throughout the course of the meeting.

P03.20.003 Minutes of the last meeting: The minutes of the meeting held on Tuesday 4 February 2020 were proposed by Cllr Booth, seconded by Cllr Aldis and approved as an accurate record of proceedings.

P03.20.004 Planning Applications; The Committee considered the following Planning Applications. The Chair agreed for the committee to consider
planning application reference 200363 which was not on the published agenda

The Chair agreed for a member of the public, a resident of Fingringhoe, to speak first with regards to planning application reference number 200331.

Background to this application was initially provided with it having been rejected in 2017 and then again following an appeal in 2018. This
was effectively the third attempt by the Harlequin Group for the installation of a telecommunications tower in Fingringhoe. It was agreed that the amendment to the previous application was the change in height of the proposed tower- with the applicants claiming that the mast would now be 5m lower. Fingringhoe Parish Council had been excluded from the consultation as had Wivenhoe Town Council. The public meeting which had taken place in September 2019 was poor. Even though the application had been rejected already on appeal it was still considered that the location of the Sewage Works, Ballast Quay Road to be the best option. It was believed that other sites had not even been considered because Anglian Water own the sewage works. The Committee discussed the existing mast at Rowhedge and also a temporary mast in Wivenhoe at Ballast Quay Farm.

Cllr Aldis reported that as the application had been rejected by the inspector the same application cannot just be resubmitted. He also advised that legislation regarding planning permission for telecommunication masts will be relaxed and it may be that the applicants can wait until this time. Cllr Tile summarised the areas of concern – visually the mast would be an eyesore locally and from across the river from Wivenhoe, there is concern about increased levels of radiation and also that once the mast had been installed there was nothing to stop other companies using it and it increasing in size. There will be lights on the tower and it was believed that the coverage proposed would not be as effective as claimed and that in fact the optimum position would be for the mast be located where the original mast was in Rowhedge but this excludes Anglian Water.

The Committee also discussed the fact that the site is a SSSI and Cllr Booth suggested that enquiries could be made with the Brightlingsea Harbour Master.

It was agreed that the objection report by the inspectorate would be provided to Cllr Aldis for review to consider why the application had been refused before – the next objection could be based on this and therefore be more effective. He advised that the public can attend the hearing although legal assistance should be considered.

WTC are of the opinion that it is possible that this development would be opening up this site to further development in the future. It is of concern that this location is outside of the settlement envelope.
WTC also have concerns, given the location on a small housing development which is frequently used by school children, about the increase in traffic created by the building works.

P03.20.008 Local Plan; Update from the Chair; Cllr Aldis reported that an extension had been granted until 9 March for some responses. The
outcome is expected at the end of March-beginning of April.
Cllr Aldis also updated the Committee on the response drafted by Cllr Luxford -Vaughan to the CBC updated policy definition on affordable housing.
Cllr Read queried whether a plan should be now considered for the actions proposed in the WNP for new allotments and cemeteries and how these will be financed. Cllr Aldis confirmed that the infrastructure will be created with S106 monies.

P03.20.009 Leisure and Community Services SPD: No report was received for this month.

P03.20.010 Date and time of the next meeting: The date of the next Planning Committee meeting was agreed as Tuesday 7 April 2020 at 7.00pm
